By accessing this Website, and any of the Company’s properties, you are acknowledging, and accepting these terms of use for all of the Company’s properties. These terms of use are subject to change at any time at the discretion of the Company without notice. Your use of any of the Company’s Websites after any changes are implemented constitutes your acceptance of the changes. As a result, we encourage you to consult the terms, and conditions herein frequently.

You acknowledge and agree that all content and materials available on this site are protected by copyrights, trademarks, service marks, patents, trade secrets, or other proprietary rights and laws. SEVER-ABILITY AND INTEGRATION

Unless otherwise specified herein, this agreement constitutes the entire agreement between you, and the Company with respect to this site, and supersedes all prior or contemporaneous communications between you and the Company with respect to this site. If any part of these Terms of Use is held invalid or unenforceable, that portion shall be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intentions of the parties, and the remaining portions shall remain in full force, and effect.

REFUND POLICY

We provide a full 7 day refund if the product has a technical defect. A technical defect is e.g. the product cannot be installed properly and if there are error messages generated in the Journal/Expert Advisors tab of MetaTrader resulting from the use of the product. Once 7 days have passed there will be no refunds.

There is no refunds if there is no desired or expected performance. This is e.g. the case if/when trade discrepancies occur or losses occur. The Forex market is extremely volatile and carries substantial risks. It is not the place to put any money that you cannot afford to lose. You can refer to our Risk Disclosure for more information. This paragraph does not affect your rights in the event that you have a genuine, and valid complaint about the way we have provided the services to you.

WEBSITE MODIFICATIONS

The Company reserves the right to modify or discontinue, temporarily or permanently, the website as a whole and/or any or all of the website features, products, prices of products, promotions, services or information appearing on, or available through, any or all of the website with or without notice to you. You agree that the Company shall not be liable to you or any third-party for any modification or discontinuance of such features, products, prices, services, or information on the Website or the Website itself.

VIRUSES, HACKING AND OTHER OFFENSES

You must not misuse our site by knowingly introducing any material which is malicious or technologically harmful. You must not attempt to gain unauthorized access to our site, the server on which our site is stored or any server, computer or database connected to our site. You must not attack our site via a denial-of-service attack or a distributed denial-of service attack. By failing to comply with this provision, you would commit a criminal offense, and your right to use our site will cease immediately, and we will report your actions to the relevant authorities.

Terms and Conditions for Use of Trading Robots

These Terms and Conditions ("Terms") govern your access to and use of the algorithmic trading software, tools, robots, Expert Advisors, strategies, signals, backtesting results, configuration services, or related products and services (collectively, the "Trading Robots") provided by Profalgo LTD, a limited liability company organized under the laws of Malta ("Profalgo LTD," "we," "us," or "our").

By accessing, downloading, installing, configuring, activating, using, or in any way interacting with the Trading Robots, you ("User," "you," or "your") confirm that you have read, understood, and unconditionally agree to be legally bound by these Terms. If you do not agree with any part of these Terms, you must immediately cease all use and delete any copies of the Trading Robots.

#1. Important Risk Warnings and No Guarantees

Trading involves substantial risk of loss and is not suitable for everyone.

  • The Trading Robots are automated software tools only. They do not and cannot guarantee profits, positive returns, break-even results, or any specific performance level.

  • Past performance of any strategy, backtest, simulation, live results shown on our website, marketing materials, screenshots, videos, testimonials, or third-party platforms is not indicative of future results.

  • You may lose all or substantially all of the capital invested in your trading account. In some cases, losses can exceed your initial deposit (especially with leveraged products such as forex, CFDs, or futures).

  • No employee, representative, affiliate, partner, or third party associated with Profalgo LTD is authorized to make any promise, guarantee, or representation of profits, low risk, or consistent positive performance.

  • Any statements about potential earnings, win rates, drawdowns, or performance metrics are illustrative, hypothetical, or historical only and should not be relied upon as factual predictions.

  • Market conditions, broker execution, slippage, spreads, commissions, platform outages, news events, liquidity issues, and many other factors outside our control can dramatically affect results — often negatively.

 

You use the Trading Robots entirely at your own risk and sole discretion.

 

#2. No Financial, Investment, or Trading Advice

  • Profalgo LTD does not provide financial advice, investment advice, trading recommendations, portfolio management, or any form of personalized or general investment service.

  • The Trading Robots are not designed, tested, or intended to meet the investment objectives, financial situation, or risk tolerance of any particular user.

  • You are solely responsible for independently evaluating whether the Trading Robots are appropriate or suitable for you, and for obtaining independent professional financial, legal, and tax advice before using them.

  • Profalgo LTD is not a broker, investment firm, asset manager, advisor, or fiduciary of any kind.

 

#3. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TRADING ROBOTS ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS AND WITHOUT ANY WARRANTY OF ANY KIND.

 

Profalgo LTD hereby expressly disclaims all warranties, express or implied, statutory or otherwise, including but not limited to:

  • warranties of merchantability, fitness for a particular purpose, title, non-infringement;

  • warranties that the Trading Robots will meet your requirements, achieve any results, be compatible with any broker/platform, operate without interruption or error, be secure, or be free from viruses, bugs, defects, or harmful code;

  • warranties regarding accuracy, completeness, timeliness, or reliability of any data, signals, strategies, backtests, or outputs generated by the Trading Robots.

 

#4. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL PROFALGO LTD, ITS SHAREHOLDERS, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, SUPPLIERS, LICENSORS, OR THIRD-PARTY PLATFORM PROVIDERS BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, EXEMPLARY, OR COVER DAMAGES) ARISING OUT OF OR IN ANY WAY CONNECTED WITH:

  • your use of, inability to use, or results obtained from the Trading Robots;

  • any trading losses, drawdowns, margin calls, account liquidation, or financial harm of any kind;

  • any inaccuracy, delay, interruption, error, omission, virus, or defect in the Trading Robots or related services;

  • any third-party platform (broker, exchange, API, VPS, data feed) issues, downtime, changes in terms, or incompatibility;

  • any decision you make or fail to make based on information from the Trading Robots.

 

This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability, breach of statutory duty, etc.) and even if Profalgo LTD has been advised of the possibility of such damages.

 

Your sole and exclusive remedy for any dissatisfaction with the Trading Robots is to stop using them.

 

In jurisdictions where some limitations are not permitted (including for gross negligence or willful misconduct where prohibited by mandatory law), Profalgo LTD’s liability is limited to the greatest extent allowed by law (which may be zero in many cases for trading software).

 

#5. Indemnification

You agree to indemnify, defend, and hold harmless Profalgo LTD and its affiliates, officers, directors, employees, agents, and suppliers from and against any and all claims, demands, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to:

  • your use of the Trading Robots;

  • any violation of these Terms or applicable law;

  • any claim by any third party (including regulators, brokers, other users) arising from your trading activity or data/strategies used with the Trading Robots.

 

This indemnification survives termination of these Terms.

#6. Additional Sections

Eligibility and User Responsibilities

You must be at least 18 years old (or the age of majority in your jurisdiction) and legally capable of entering into binding contracts to use the Trading Robots. You represent and warrant that you meet these requirements and that your use complies with all applicable laws, including export controls and sanctions (e.g., no use if you are in a restricted country under EU or international sanctions). You are responsible for all activity under your account, maintaining confidentiality of login credentials, and ensuring compatibility of your systems with the Trading Robots. You agree not to use the Trading Robots for illegal purposes, including market manipulation or violating broker terms.

 

License and Intellectual Property

Profalgo LTD grants you a limited, non-exclusive, non-transferable, revocable license to use the Trading Robots solely for personal, non-commercial trading purposes on your own accounts, subject to these Terms. All intellectual property rights (including code, algorithms, strategies, trademarks, copyrights) remain with Profalgo LTD or its licensors. You may not copy, modify, reverse-engineer, decompile, disassemble, distribute, rent, lease, sublicense, or create derivative works of the Trading Robots. Unauthorized use may result in immediate termination and legal action.

 

Third-Party Platforms and Integrations

The Trading Robots may integrate with third-party platforms (e.g., MetaTrader, brokers, APIs). You are solely responsible for complying with those platforms' terms, ensuring compatibility, and bearing any associated risks or costs (e.g., VPS fees). Profalgo LTD is not liable for third-party changes, downtime, or issues.

 

Termination

Profalgo LTD may terminate or suspend your access at any time, without notice or liability, for any reason, including violation of these Terms. Upon termination, you must cease use and delete all copies. Sections that by nature survive (e.g., disclaimers, limitation of liability, indemnification, governing law) continue in effect.

 

Amendments and Updates

We may update or amend these Terms at any time by posting the revised version on our website and/or notifying you via email or in-app notice. Changes take effect 30 days after posting/notification unless stated otherwise. Your continued use after the effective date constitutes acceptance. If you do not agree, stop using the Trading Robots.

 

Force Majeure

Profalgo LTD is not liable for failure or delay in performance due to events beyond reasonable control, including natural disasters, war, terrorism, cyber attacks, government actions, internet failures, or supply shortages.

 

Privacy and Data Protection

Your privacy is important. We process personal data in accordance with our Privacy Policy [https://www.forexeasolutions.com/privacy], compliant with the EU General Data Protection Regulation (GDPR) and Malta's Data Protection Act. By using the Trading Robots, you consent to such processing as described.

 

Governing Law and Dispute Resolution

These Terms are governed by the laws of Malta, without regard to conflict of laws principles. Any disputes arising out of or in connection with these Terms (including non-contractual disputes) shall be finally settled by arbitration under the rules of the Malta Arbitration Centre (MAC), conducted in English in Valletta, Malta, by one arbitrator appointed in accordance with MAC rules. The award is final and binding. You waive any right to jury trial or class actions.

 

Miscellaneous

  • Severability: If any provision is held invalid or unenforceable, the remainder remains in full force.

  • Entire Agreement: These Terms constitute the entire agreement, superseding prior understandings.

  • No Waiver: Failure to enforce any right does not waive it.

  • Assignment: You may not assign these Terms without our consent; we may assign freely.
